Section 14-26-8-7 - Docketing of petition; notice of hearing(a) Within ten (10) days after the filing of a petition, the clerk shall docket the petition as a cause of action pending in the circuit or superior court. The clerk shall cause notice to be given at least thirty (30) days before the date set for the hearing as follows:(1) By publication one (1) time each week for two (2) consecutive weeks: (A) with each publication: (i) in not less than two (2) newspapers of general circulation published in each county in which the lake is located; or(ii) if there are not two (2) newspapers of general circulation published in a county, in one (1) newspaper of general circulation published in the county; or(B) with the first publication of notice in a newspaper or newspapers described in clause (A) and the second publication of notice:(i) in accordance with IC 5-3-5; and(ii) on the official web site of each county in which the lake is located.(2) By posting a written or printed notice at the door of the courthouse in each county in which the lake lies.(3) By sending written notice to the following:(A) The county surveyor and county commissioners of each county affected.(b) The notice must do the following:(1) Briefly describe the location and nature of the proposed work contained in the petition.(2) Fix a day for the hearing on the petition.Pre-1995 Recodification Citation: 13-2-18-3 part.
