Section 12-10-6-5 - Individuals with a mental illness; comprehensive care plan; rules(a) An individual who is determined under section 2.1(a)(2) of this chapter to be incapable of residing in the individual's own home because of mental illness may be admitted to a home or facility that provides residential care to the extent that money is available for the care.(b) Within thirty (30) days after an individual with a mental illness is placed in a home or facility that provides residential care, a comprehensive care plan must be developed for the individual.(c) The residential care facility, in cooperation with the community mental health center or an individual's managed care provider (as defined in IC 12-7-2-127(b)) serving the area in which the residential care facility is located, shall develop the comprehensive care plan for the individual. The plan must include the following:(1) Psychosocial rehabilitation services that are provided within the community.(2) A comprehensive range of activities to meet multiple levels of need, including the following: (A) Recreational and socialization activities.(C) Educational, training, occupational, and work programs.(D) Opportunities for progression into less restrictive and more independent living arrangements.(3) Appropriate alternate placement if the individual's needs cannot be met by the facility.(d) The Indiana department of health shall, in coordination with the division of mental health and addiction and the division, adopt rules under IC 4-22-2 to govern: (1) residential care; and(2) the comprehensive care plan; provided to individuals with a mental illness who reside under this chapter in a home or facility that provides residential care.
