Section 10-14-3-21 - Public property; leases and contracts; employment of personnel(a) If the governor considers it to be in the public interest, on terms and conditions as the governor considers necessary to promote the public welfare and protect the interests of the state, the governor may:(1) authorize a department or an agency of the state to lease or lend real or personal property of the state to the President of the United States, the heads of the armed forces, or the Federal Emergency Management Agency; and(2) enter into a contract on behalf of the state for the:(A) lease or loan to a political subdivision of the state of real or personal property of the state; or(B) temporary transfer or employment of personnel of the state to or by a political subdivision of the state.(b) The president of the county fiscal body and the president of the county executive, if the county does not contain a consolidated city, or the county executive, if the county contains a consolidated city, of each county of the state and the executive of each city and town in the state may, in accordance with the emergency management program and emergency operations plan of the county in which the city or town is located, do the following: (1) Enter into a contract or lease with the state, accept any loan, or employ personnel. A political subdivision may equip, maintain, use, and operate any property and employ necessary personnel in accordance with the purposes for which the contract is executed.(2) Do all things and perform acts that the governor considers necessary to effectuate the purpose of the contract.Pre-2003 Recodification Citation: 10-4-1-14.
