Section 755 ILCS 6/11-10 - [Effective 1/1/2025] Scope(This Section may contain text from a Public Act with a delayed effective date)
(a) Except as provided in subsection (b), this Article applies to an electronic nontestamentary estate planning document and an electronic signature on a nontestamentary estate planning document.(b) This Article does not apply to a nontestamentary estate planning document, will, or terms of a trust if the terms governing the document expressly preclude use of an electronic record or electronic signature.(c) This Article does not affect the validity of an electronic record or electronic signature that is valid under: (1) the Illinois Uniform Electronic Transactions Act;(2) any other Section of this Act; or(3) any other State law relating to nontestamentary estate planning documents.Amended by P.A. 103-0666,§ 5, eff. 1/1/2025.Added by P.A. 103-0301,§ 10, eff. 1/1/2024.This section is set out more than once due to postponed, multiple, or conflicting amendments.
