Section 505 ILCS 35/5-1 - Critical Habitat Private Sector Matching Fund
(a) The Critical Habitat Private Sector Matching Fund is hereby created as a special fund in the State treasury to fund the program established by this Article V.
(b) The Critical Habitat Private Sector Matching Fund shall consist of contributions from private sources and appropriations.
(c) Appropriations to the Fund may be expended only to the extent that they are matched equally with contributions to the Fund from private sources. The private contributions may be made in cash or in contributions of land or interests in land that are designated by the Director of Natural Resources as program acquisitions. For the purposes of this Section, the private contributions of land or interests in land shall be valued in accordance with their appraised value.
(d) The Director of Natural Resources may accept contributions and pledges to the Fund. A pledge that is made contingent on an appropriation is acceptable and shall be reported with other pledges as required in this Section. In the budget request for each year, the Director of Natural Resources shall report to the Governor and General Assembly the amount of private contributions to the Fund during the previous calendar year. The Governor shall request, and the General Assembly may appropriate, funds to match the amount of annual private contributions to the Fund.

Money in the Fund may be expended only for the direct acquisition or improvement of land or interests in land as provided in this Article V. "Acquisition" includes: (1) purchase of land or an interest in land by the Director of Natural Resources; or (2) acceptance by the Director of Natural Resources of gifts of land or interests in land as program projects.
