(a) Except as otherwise provided in subsection (b), venue for a judicial proceeding involving a trust is in the judicial circuit of this State in which the trust's principal place of administration is or will be located and, if the trust is created by will and the estate is not yet closed, in the judicial circuit in which the decedent's estate is being administered.(b) If a trust has no trustee, venue for a judicial proceeding for the appointment of a trustee is in: (1) A judicial circuit of this State in which a beneficiary resides;(2) A judicial circuit in which any trust property is located; (3) If the trust is created by will, the judicial circuit in which the decedent's estate was or is being administered; or (4) The judicial circuit where the nominated trustee resides or has its principal place of business.Added by L 2021, c 32,§ 2, eff. 1/1/2022.
