Section 124B-11 - Apprehension
(a) Any person authorized by this chapter or title 10 United States Code chapter 47, or by rules or regulations issued under either, any marshal of a court-martial appointed pursuant to this chapter, and any peace officer authorized by law, may apprehend persons subject to this chapter upon probable cause that an offense has been committed and that the person apprehended committed it.
(b) Commissioned officers, warrant officers, petty officers, and noncommissioned officers may quell quarrels, affrays, and disorders among persons subject to this chapter and apprehend persons subject to this chapter who take part therein.
(c) If an alleged offender is apprehended outside the State, the alleged offender's return to the State shall be in accordance with normal extradition procedures or by reciprocal agreement.
(d) No person authorized by this section to apprehend persons subject to this chapter or place where the alleged offenders are confined, restrained, held, or otherwise housed may require payment of any fee or charge for so receiving, apprehending, confining, restraining, holding, or otherwise housing the persons except as provided by law.
