Any provider procuring a payment under any medical assistance program administered by the division who violates any of the provisions of sections thirty-nine to forty-six, inclusive, shall be ineligible to participate further in the program for a period of three years next subsequent to the date of conviction for said violation; provided, however, that a vendor shall not be considered in violation of said sections thirty-nine to forty-six, inclusive, upon submission of proof, to the satisfaction of the commissioner, that such violation was due solely to a clerical or administrative error.
