Section 94:129 - Violations; penalties; jurisdiction

Any person who violates any provision of sections one hundred and eighteen to one hundred and twenty-eight, inclusive, or any regulation or order issued under the authority of said sections shall be punished by imprisonment for not more than one year or a fine of not more than three thousand dollars, or both such imprisonment and fine; except that any person who knowingly attempts to distribute in commerce an adulterated article or an unexempted article which has not been inspected under the provisions of this chapter, or who commits a violation which involves intent to defraud, shall be punished by imprisonment of not less than one year nor more than three years or a fine of not less than three thousand dollars and not more than ten thousand dollars, or both such imprisonment and fine.

The superior court in equity is vested with jurisdiction specifically to enforce, and to prevent and restrain violations of sections one hundred and eighteen to one hundred and twenty-eight, inclusive.
