No person shall sell, offer, or expose for sale a commercial fertilizer or brand of commercial fertilizer, soil conditioner, or agricultural liming material if its labeling is false or misleading in any particular way, or it is distributed under the name of another product, or it is not labeled as required in section sixty-six and in accordance with rules and regulations as prescribed in section seventy-five or it purports to be or is represented as a commercial fertilizer, or represented as a plant nutrient or commercial fertilizer, unless such plant nutrient or commercial fertilizer conforms to the definition of identity, if any, prescribed by regulations.
No person shall sell, offer or expose for sale a commercial fertilizer or brand of commercial fertilizer if it contains any deleterious or harmful ingredient in sufficient amount to render it injurious to beneficial plant life when applied in accordance with directions for use on the label, or if adequate warning statements or directions for use, which may be necessary to protect plant life are not shown on the label, or its composition falls below or differs from that which it is purported to possess by its labeling, or it contains unwanted crop seed or weed seed.
