Section 626.8305 - Prohibition against the unlicensed transaction of health insuranceExcept as provided in s. 626.112(6), with respect to any line of authority specified in s. 626.015(8), an individual may not, unless licensed as a health agent:
(1) Solicit insurance or procure applications; or(2) In this state, engage or hold himself or herself out as engaging in the business of analyzing or abstracting insurance policies or of counseling or advising or giving opinions to persons relative to insurance contracts, unless the individual is: (a) A consulting actuary advising insurers;(b) An employee of a labor union, association, employer, or other business entity, or the subsidiaries and affiliates of each, who counsels and advises such entity or entities relative to their interests and those of their members or employees under insurance benefit plans; or(c) A trustee advising a settlor, a beneficiary, or a person regarding his or her interests in a trust, relative to insurance benefit plans. s.34, ch. 2002-206; s.965, ch. 2003-261; s.114, ch. 2004-5; s.29, ch. 2017-175.Amended by 2017 Fla.
