Section 1008.3415 - School grade or school improvement rating for exceptional student education centers(1) Each exceptional student education center shall choose to receive a school grade pursuant to s. 1008.34 or a school improvement rating pursuant to s. 1008.341.(2) Notwithstanding s. 1008.34, the achievement levels and Learning Gains of a student with a disability who attends an exceptional student education center and has not been enrolled in or attended a public school other than an exceptional student education center for grades K-12 within the school district shall not be included in the calculation of the home school's grade if the student is identified as an emergent student on the alternate assessment described in s. 1008.22(3)(d).(3) A charter school that is an exceptional student education center and that receives two consecutive ratings of "maintaining" or higher may replicate its educational program under s. 1002.331(3). The Commissioner of Education, upon request by a charter school, shall verify that the charter school meets the requirements of this subsection and provide a letter to the charter school and the sponsor stating that the charter school may replicate its educational program in the same manner as a high-performing charter school under s. 1002.331(3).(4) The State Board of Education shall adopt rules under ss. 120.536(1) and 120.54 to implement this section, including, but not limited to, defining exceptional student education centers.s. 8, ch. 2013-236; s. 8, ch. 2014-23; s.75, ch. 2014-39; s. 13, ch. 2021-35; s. 12, ch. 2021-157.Amended by 2021 Fla.
