Section 7707 - [Effective 2/1/2025] Limitation on liability(a) Nothing in this chapter precludes a petitioner or law-enforcement officer from removing a firearm, projectile weapon, or ammunition under other authority or filing criminal charges when probable cause exists.(b) A law-enforcement officer, who in good faith does not seek a lethal violence protective order under this chapter, is immune from civil liability.(c) A law-enforcement agency is immune from civil or criminal liability for any damage or deterioration of a firearm, projectile weapon, or ammunition stored or transported under this section. This subsection does not apply if the damage or deterioration occurred as a result of recklessness, gross negligence, or intentional misconduct by the law-enforcement agency or federally-licensed firearms dealer.Amended by Laws 2023, ch. 525,s 44, eff. 2/1/2025.Added by Laws 2017 , ch. 274, s 1, eff. 12/27/2018.This section is set out more than once due to postponed, multiple, or conflicting amendments.
