1. A violation of any provision of the preceding section shall constitute a misdemeanor.2. Proof that no person has been misled or deceived or otherwise damaged by any violation of this article shall not constitute a defense in any prosecution under this article.3. It shall not be necessary, in order to make out a prima facie case, for the prosecution to prove that the defendant knowingly or intentionally violated any provision of this article but proof that the defendant did not knowingly or intentionally violate such provision shall constitute a good defense in any prosecution for a misdemeanor under this article.
