Section 44-40-117 - Penalties
(1) In addition to any other penalties that may apply, any person violating any of the provisions of section 44-40-116 commits a class 2 misdemeanor and shall be punished as provided in section 18-1.3-501.
(2) Any person violating the sale restrictions of section 44-40-116(1)(c) may also be proceeded against pursuant to section 18-6-701 for contributing to the delinquency of a minor.
(3) A person issuing, suspending, revoking, or renewing contracts pursuant to section 44-40-106 or licenses pursuant to section 44-40-107 for personal pecuniary gain or a thing of value as defined in section 18-1-901(3)(r), or a person violating the provisions of section 44-40-110 , commits a class 4 felony and shall be punished as provided in section 18-1.3-401.
(4) Any person violating any of the provisions of this article 40 relating to disclosure by providing any false or misleading information commits a class 6 felony and shall be punished as provided in section 18-1.3-401.

(1) This section is similar to former § 24-35-215 as it existed prior to 2018.

(2) Section 77 of chapter 298 (HB 23-1293), Session Laws of Colorado 2023, provides that the act changing this section applies to offenses committed on or after October 1, 2023.
