Section 42-2-408 - Unlawful acts - penalty
(1) It is unlawful for any person other than an employee of the department to perform commercial driver's license driving tests, to act as a commercial driver's license testing unit, or to act as a commercial driver's license driving tester unless such person has been duly licensed by the department under the provisions of section 42-2-407.
(2) Any person who violates the provisions of this section commits a petty offense and, upon conviction thereof, shall be punished as provided in section 18-1.3-503.

(1) This section is similar to former § 42-2-508 as it existed prior to 1994, and the former § 42-2-408 was relocated to § 42-2-308 .

(2) Section 803(2) of chapter 462 (SB 21-271), Session Laws of Colorado 2021, provides that the act changing this section applies to offenses committed on or after March 1, 2022.
