Section 24-34-602 - Penalty and civil liability(1)(a) Any person who violates section 24-34-601 shall be fined three thousand five hundred dollars for each violation. A person aggrieved by the violation of section 24-34-601 may bring an action in any court of competent jurisdiction in the county where the violation occurred. Upon finding a violation, the court shall order the defendant to pay the fine to the aggrieved party and to comply with the provisions of section 24-34-601.(b) Notwithstanding the provisions of paragraph (a) of this subsection (1), a person who violates the provisions of section 24-34-601 based on a disability shall be subject to the provisions of section 24-34-802.(3) The relief provided by this section is an alternative to that authorized by section 24-34-306 (9), and a person who seeks redress under this section is not permitted to seek relief from the commission.Amended by 2024 Ch. 224,§ 2, eff. 8/7/2024.Amended by 2014 Ch. 250, § 8, eff. 8/6/2014.Amended by 2013 Ch. 127, § 1, eff. 4/19/2013.L. 79: Entire part R&RE, p. 937, § 3, effective July 1.
