Colo. Rev. Stat. § 13-21-203.5
In a case arising under section 13-21-202, the persons entitled to sue under section 13-21-201(1) may elect in writing to sue for and recover a solatium in the amount of fifty thousand dollars. The solatium amount is in addition to economic damages and to reasonable final disposition expenses, which expenses may also be recovered in an action under this section. The solatium amount is in lieu of noneconomic damages recoverable under section 13-21-203 and is awarded upon a finding or admission of the defendant's liability for the wrongful death.

Section 31(2) of chapter 123 (SB 21-006), Session Laws of Colorado 2021, provides that the act changing this section applies to final dispositions of human remains or human fetuses made on or after September 7, 2021.
