Section 12-155-104 - [Effective 7/1/2025] State plumbing board - subject to review - repeal of article(1) There is established in the division the state plumbing board. The board is a type 1 entity, as defined in section 24-1-105, and exercises its powers and performs its duties and functions under the department of regulatory agencies.(2)(a)(I) The board consists of seven members appointed by the governor, with the power of removal, and with the confirmation of the senate, as follows: (A) One a Journeyworker plumber;(B) One a master plumber;(C) Two engaged in the construction of residential or commercial buildings as plumbing contractors;(D) One engaged in the construction of residential or commercial buildings as a general contractor;(E) One a member or employee of a local government agency conducting plumbing inspections; and(F) One appointed from the public at large.(II) A representative of the department of public health and environment shall serve as an ex officio nonvoting member.(III) At least one member shall be a resident of the western slope of the state, defined as that western part of the state separated from the eastern part of the state by the continental divide.(b) A majority of the board shall constitute a quorum for the transaction of all business.(3)(a) Board members are appointed for four-year terms. Any vacancy occurring in the membership of the board shall be filled by the governor by appointment for the unexpired term of the member.(b) The governor may remove any member of the board for misconduct, incompetence, or neglect of duty.(4) [Repealed by 2024 Amendment.](5) This article 155 is repealed, effective September 1, 2032.
