Section 12-701 - Federally assisted watershed projects(a) In this section, "Act" means the federal Watershed Protection and Flood Prevention Act.(b) The provisions of §§ 9-105 and 9-106 of this article apply to an act, an ordinance, or a resolution adopted by a commission county under this section.(c) The governing body of a county may:(1) carry out, construct, operate, and maintain any works of improvement in watershed or subwatershed areas qualifying for federal assistance under the Act for: (ii) the conservation, development, use, and disposal of water;(2) satisfy the conditions for federal assistance required under the Act;(3) accept federal grants and technical assistance in accordance with the Act;(4)(i) borrow federal money in accordance with the Act for works of improvement identified under item (1) of this subsection; and(ii) notwithstanding any public general law or public local law, evidence the borrowing by issuing instruments that are acceptable to the United States or any of its agencies; and(5) borrow money from private lending institutions and evidence the borrowing by issuing instruments in accordance with Title 19, Subtitle 2 of this article, the county charter, or local laws.Revised and recodified by 2013 Md.
