Section 1-401 - Computer software programs(a) In this section, "computer software program" means a software program used to: (1) access data in a computer system; or(2) implement a process using data in a computer system.(b) This section does not apply to a computer software program subject to Title 10, Subtitle 9 of the State Government Article.(c)(1) A county or municipality may sell, lease, or license to the public, or enter into a contract concerning, a computer software program, including any associated patent, trademark, or copyright, that is produced by or for the county or municipality in the normal course of its operations.(2) A county or municipality may adopt a price structure for a computer software program based on any factors that the county or municipality considers relevant, including: (i) the cost of producing, reproducing, and delivering the computer software program;(ii) overhead and labor costs; and(iii) the fair market value of the computer software program.Revised and recodified by 2013 Md.
