Section 125.9 - [Repealed Effective 7/1/2025] Powers of director

The director may:

1. Plan, establish and maintain treatment, intervention, education, and prevention programs as necessary or desirable in accordance with the comprehensive substance use disorder program.
2. Make contracts necessary or incidental to the performance of the duties and the execution of the powers of the director, including contracts with public and private agencies, organizations and individuals to pay them for services rendered or furnished to persons with a substance use disorder.
3. Solicit and accept for use any gift of money or property made by will or otherwise, and any grant of money, services or property from the federal government, the state, or any political subdivision thereof or any private source, and do all things necessary to cooperate with the federal government or any of its agencies and the department in making an application for any grant.
4. Coordinate the activities of the department and cooperate with substance use disorder programs in this and other states, and make contracts and other joint or cooperative arrangements with state, local, or private agencies in this and other states for the treatment of persons with a substance use disorder and for the common advancement of substance use disorder programs.
5. Require that a written report, in reasonable detail, be submitted to the director at any time by any agency of this state or of any of its political subdivisions in respect to any substance use disorder prevention function, or program for the benefit of persons who are or have been involved in substance use disorder, which is being conducted by the agency.
6. Submit to the governor a written report of the pertinent facts at any time the director concludes that any agency of this state or of any of its political subdivisions is conducting any substance use disorder prevention function, or program for the benefit of persons who are or have been involved in substance use disorder, in a manner not consistent with or which impairs achievement of the objectives of the state plan to combat substance use disorder, and has failed to effect appropriate changes in the function or program.
7. Keep records and engage in research and the gathering of relevant statistics.
8. Employ a deputy director who shall be exempt from the merit system. The director may employ other staff necessary to carry out the duties assigned to the director.
9. Do other acts and things necessary or convenient to execute the authority expressly granted to the director.
