Section 23-4-3 - [See Note] Claim of legal and equitable relief by defendant

A defendant to any action in the superior court or in the Georgia State-wide Business Court or the Georgia Tax Court, whether the action is for legal or equitable relief, may claim legal or equitable relief, or both, by framing proper pleadings for that purpose and sustaining them by sufficient evidence.

Amended by 2024 Ga. Laws 601,§ 2-9, eff. 7/1/2026 only if an amendment to the Constitution to provide that the Georgia Tax Court shall have state-wide jurisdiction as provided by law and that decisions of such court shall be appealed to the Court of Appeals, subject to review by the Supreme Court of Georgia, is ratified by the voters at the November, 2024, state-wide general election.
