Section 45-52-82.04 - Additional booking fee - Sheriff's Law Enforcement Fund, General Fund
(a) In Morgan County, a booking fee in the amount of twenty dollars ($20) shall be assessed as court costs against each criminal defendant incarcerated in or booked into the Morgan County Jail, such booking fee to be assessed pursuant to this section in addition to all other fines, court costs, or other charges now or hereafter provided by law.
(b) The booking fee imposed by this section shall be assessed by the clerk of the court if such defendant is convicted in a criminal case prosecuted in the Circuit Court or District Court of Morgan County. The clerk of the court shall enter the amount of the booking fee on the docket sheet and collect the same in the same manner and at the same time as other court costs are collected in criminal cases.
(c) The clerk of the circuit court or district court, as the case may be, shall remit on a monthly basis the booking fees collected pursuant to this section to the Sheriff of Morgan County who, upon receipt of the booking fees, shall deposit one-half of the same to the Sheriff's Law Enforcement Fund and remit the other one-half to the Morgan County Commission, for deposit to the Morgan County General Fund. The balance from time to time in the Sheriff's Law Enforcement Fund shall be used exclusively for law enforcement purposes and for the discharge by the sheriff of the duties of his or her office and as the sheriff in his or her sole discretion shall deem to be in the public's interest.
(d) The establishment of the Sheriff's Law Enforcement Fund and use of the proceeds thereof shall not diminish or take the place of any other source of income established for the sheriff for the operation of the office of the Sheriff of Morgan County.
