Section 45-52-244.06 - Disposition of funds

The Morgan County Commission may retain and deposit to the General Fund of Morgan County, for general fund purposes and uses, 10 percent of the total amount of the special county tax collected in the county under this part. Such amount shall be in lieu of any payment to Morgan County for collecting the special tax and may be deducted each month from the gross revenues from the special tax before distribution of the balance of the tax as herein provided. Any incorporated municipality within the county gross receipts tax area, by resolution of the municipal governing body, may elect to share in the proceeds of the special privilege license tax levied by this part and thereafter, upon compliance with the procedure hereinafter provided, shall be entitled to receive a pro rata share of the net proceeds of the tax herein levied, based upon the amount of tax collected within the corporate boundaries of the municipality. The municipal clerk shall immediately after adoption of the resolution notify the Morgan County Commission of the action. The share of the monthly distribution to which each municipality shall be entitled shall be the ratio which the gross amount of tax collected within each municipality during the preceding month bears to the total tax collected within the entire county gross sales tax area during the same month. No later than the 20th day of each month, the Morgan County Commission, or its designee, after deducting 10 percent of the gross tax collected hereunder and depositing the same to the General Fund of Morgan County, shall distribute to each municipality which has theretofore made the election provided for herein-above that municipality's share of the net taxes collected as of the end of the preceding month. Ninety percent of the balance then remaining shall be distributed to the Morgan County Board of Education and the remaining shall be distributed to the Morgan County Association of Volunteer Fire Departments, Inc., and utilized by it to support and improve rural fire departments within Morgan County.
