Section 45-52-234.28 - Failure to appear
(a) An individual who is released on an appearance bond or other security pursuant to this subpart and who knowingly fails to appear before any court or judicial officer as required shall incur a forfeiture of such bond or any security which was given or pledged for his or her release and, in addition, may be guilty of bail jumping and punished therefor as provided in the Alabama Criminal Code.
(b) A defendant's bond or other security may be forfeited under this section, even if he or she has not received actual notice of the appearance date, if (1) reasonable efforts to notify the defendant have been made, and (2) the defendant, by his or her own actions, has frustrated the receipt of actual notice.
(c) Except as otherwise provided by general law, all forfeitures of cash or other security deposited with the clerk of any court, and all deposits otherwise made and retained pursuant to this subpart shall be paid over to the Morgan County Community Corrections and Court Services Fund created by Section 45-52-234.23 and used to implement this subpart.
