Section 45-52-233.03 - Fee for services rendered; disposition of funds
(a) The Sheriff of Morgan County may establish certain reasonable fees for services rendered by the sheriff including, but not limited to, making and providing copies of incident reports; making and providing where authorized by law criminal history investigations and reports thereon; sending documents by facsimile or other transmission; and providing photographs and photocopies of photographs and other documents.
(b) The sheriff shall remit monthly 20 percent of the fees collected pursuant to this section to the Morgan County Commission for deposit to the county general fund. The balance of such fees shall be deposited by the sheriff into a law enforcement fund maintained by the sheriff in any bank in Morgan County and shall be used exclusively for law enforcement purposes and in the discharge by the sheriff of the duties of his or her office in such manner as in the discretion of the sheriff are in the public's interest.
(c) Any actions of the sheriff or his or her agents prior to May 14, 2004, which are in compliance with this section are ratified and confirmed.
(d) The establishment of the law enforcement fund and use of the proceeds therefrom shall not diminish or take the place of any other source of income established for the sheriff or the operation of the office of sheriff.
