Section 36-21-55.4 - Compliance with the reporting requirements(a) The Alabama Peace Officers' Standards and Training Commission shall randomly audit law enforcement agencies' compliance with the reporting requirements under Section 36-21-55.1.(b)(1) If the commission determines that a law enforcement agency is not in compliance with the requirements under Section 36-21-55.1, it shall notify the law enforcement agency by registered or certified mail of the results of its audit. The law enforcement agency shall have 30 days from receipt of notice to reach compliance with the requirements of Section 36-21-55.1. If a law enforcement agency does not reach compliance within 30 days from receipt of notice, the commission may assess a civil penalty against the agency in the amount of one thousand dollars ($1,000) for each violation and an additional one hundred dollars ($100) thereafter for each day the information is not reported to the commission for entry into the database pursuant to Section 36-21-55.1.(2) If the commission determines that the law enforcement agency made a good-faith effort to report the information as required under Section 36-21-55.1, or that noncompliance was due to a technical error, the commission may waive the assessment of any civil penalty.(3) Any civil penalties collected by the commission under this subsection shall be deposited into the Alabama Peace Officers' Standards and Training Fund to be used by the commission for the implementation and enforcement of this division.(c) The commission may adopt rules relating to the audit and assessment, collection, or waiver of civil penalties as provided in this section.(d) Nothing in this division shall be construed as reducing the standards and requirements established by the commission.Ala.
