Section 36-21-7 - Reimbursement by new employer for training expenses(a) When a law enforcement officer, certified corrections officer, fire protection personnel, or firefighter of the state or any political subdivision of the state is employed by a different agency of the state or political subdivision of the state within 36 months after completing the training requirements mandated by Article 3, commencing with Section 36-21-40, or by Chapter 32, commencing with Section 36-32-1, all of the following expenses shall be reimbursed to the agency of the state or political subdivision of the state which paid for the training: (1) The total expense of the training, including, but not limited to, salary paid during training when the trainee was not providing services to the state agency or political subdivision of the state in consideration for the salary, transportation costs paid to the trainee for travel to and from the training facility, room, board, tuition, overtime paid to other employees who fill in for the trainee during his or her absence, and any other related training expenses.(2) The cost of any customized personal protective ensemble or custom fitted uniform item purchased by the agency of the state or political subdivision of the state for use by the trainee, either during or after training.(b) The agency of the state or political subdivision of the state that paid for the training shall, within 12 months of the former trainee's first day of employment with the new employer, submit an itemized sworn statement to the new employer of the former trainee, and shall demand payment thereof, and may enforce collection of the obligation through civil remedies and procedures.(c) The term "law enforcement officer" shall have the same meaning as in Section 36-21-40 and the term "fire protection personnel and firefighter" shall have the same meaning as in Section 36-32-1.
