Section 35-NEW - [Newly enacted section not yet numbered] [Effective 1/1/2025] Notice and opportunity for hearing(a) Except as otherwise provided in subsection (b), the court may issue an order under this act only after notice and opportunity for a hearing appropriate in the circumstances.(b) The court may issue a preliminary order under this act in any of the following circumstances: (1) Without prior notice if the circumstances require issuance of an order before notice is given.(2) After notice and without a prior hearing if the circumstances require issuance of an order before a hearing is held.(3) After notice and without a hearing, provided the court finds that the administration of justice will be preserved without a hearing.(c) Upon request by an interested party for rehearing of a preliminary order entered under subdivision (b)(1) or (b)(2), the court shall schedule a hearing to make the order final and in compliance with subsection (a).Ala.
