Section 38603 - Separate seat location(a) A person operating a recreational off-highway vehicle with a model year of 2014 or later on lands, as described in Section 38001, shall not allow a passenger to occupy a separate seat location not designed and provided by the manufacturer for a passenger.(b) Seats that are installed in a separate seat location not designed and provided by the manufacturer for a passenger in a vehicle with a model year of 2013 or earlier on lands, as described in Section 38001, may be occupied by a passenger if the occupant of the seat is fully contained inside of the vehicle's rollover protection structure at all times while the vehicle is being operated.Amended by Stats 2019 ch 469 (SB 785),s 15, eff. 1/1/2020.Amended by Stats 2013 ch 179 (SB 234),s 1, eff. 8/27/2013.Amended by Stats 2012 ch 529 (AB 1266),s 1, eff. 9/25/2012.Added by Stats 2012 ch 165 (AB 1595),s 3, eff. 1/1/2013.
