Section 68109 - Court cooperation with INS to place deportation hold on criminal defendant(a) Every court of this state shall cooperate with the United States Department of Homeland Security (DHS) to identify and place a deportation hold on any defendant convicted of a felony who is determined to be an undocumented immigrant subject to deportation.(b) As used in this section, "cooperate" means to provide the DHS and its agents with access to all court records available to the public pursuant to Division 10 (commencing with Section 7920.000) of Title 1 and to provide any necessary paperwork within a reasonable time.(c) As used in this section, "immigrant" means a person who is not a citizen or national of the United States.Amended by Stats 2022 ch 28 (SB 1380),s 77, eff. 1/1/2023.Amended by Stats 2021 ch 296 (AB 1096),s 32, eff. 1/1/2022.Added by Stats. 1994, Ch. 563, Sec. 2.
