In addition to a registration fee, a charitable corporation or trustee, commercial fundraiser, fundraising counsel, coventurer, charitable fundraising platform, or platform charity may be assessed a late fee or an additional fee of twenty-five dollars ($25) for each month or part of the month after the date on which the registration statement and financial report were due to be filed or after the period of extension granted for the filing, if the charitable corporation or trustee, commercial fundraiser, fundraising counsel, coventurer, charitable fundraising platform, or platform charity does any of the following:
(a) Exists and operates in California without being registered.(b) Solicits contributions in California without being registered or, if applicable, bonded.(c) Fails to file its first report no later than four months and 15 days following the close of each calendar or fiscal year and has not requested an extension of time to file the annual report.(d) Fails to file its subsequent annual report no later than four months and 15 days following the close of each calendar or fiscal year subsequent to the filing of the first report and has not requested an extension of time to file the annual report.(e) Fails to file its annual registration/renewal form within the time specified by the Attorney General irrespective of other report filing requirements.(f) Fails to correct the deficiencies in its registration or annual report within 10 days of receipt of written notice of those deficiencies.This section shall become operative on January 1, 2023.
