Section 6-14-121 - Runoff elections(a)(1) Whenever there are more than two (2) candidates for election to any position on a board of directors at any election held in this state and whenever no candidate for any school district position receives a majority of the votes cast for the office or whenever there is a tie vote, there shall be a runoff election held in the school district.(2) The names of the two (2) candidates receiving the highest number of votes, but not a majority, shall be placed on the ballot to be voted upon by the qualified electors for that position on a school district board of directors.(3) The runoff election shall be held: (A) Four (4) weeks following the date of an election held in any odd-numbered year;(B) On the date designated for the general primary election if the annual school election is held with the preferential primary election; or(C) On the date designated for the general runoff election if the annual school election is held with the general election.(b) The person receiving the majority of the votes cast for the position at the runoff election shall be declared elected.(c) If one (1) of the two (2) candidates who received the highest number of votes for a position withdraws before certification of the result of the school election, the remaining candidate who received the most votes at the school election shall be declared elected to the office and there shall be no school election runoff.(d)(1) In the event that the two (2) candidates seeking election to the same school district position shall receive the same number of votes in a runoff election, a tie shall be deemed to exist.(2) The county board of election commissioners shall determine the winner by lot at an open public meeting and in the presence of the two (2) candidates.(e) The provisions of this section are intended to be in addition to and supplemental to the laws of this state pertaining to the election of school district boards of directors.(f) A runoff election shall be conducted using the same procedures as the election requiring the runoff election.Amended by Act 2019, No. 552,§ 7, eff. 7/24/2019.Amended by Act 2017, No. 910,§ 6, eff. 1/1/2018.Amended by Act 2017, No. 1104,§ 1, eff. 8/1/2017.Acts 1987, No. 845, §§ 1, 2; 1993, No. 294, § 8; 1997, No. 443, § 10; 1999, No. 1078, § 53; 2005, No. 1174, § 9; 2007, No. 1049, § 6.
