Section 5-39-204 - Aggravated residential burglary(a) A person commits aggravated residential burglary if he or she commits residential burglary as defined in § 5-39-201 of a residential occupiable structure, and either:(1) The residential occupiable structure is occupied by another person; or(2) He or she is armed with a deadly weapon or represents by word or conduct that he or she is armed with a deadly weapon.(b) Aggravated residential burglary is a:(1) Class Y felony if:(A) Committed under subdivision (a)(2) of this section; or(B) The person causes or attempts to cause death or serious physical injury to another person; or(2) Class A felony if otherwise committed.Amended by Act 2023, No. 659,§ 38, eff. 1/1/2024.Acts 2007, No. 1608, § 1.
