Section 28-40-202 - Action for declaratory judgment(a) Any person who executes a will disposing of all or part of an estate located in Arkansas may institute an action in the circuit court of the appropriate county of this state for a declaratory judgment establishing the validity of the will.(b) All beneficiaries named in the will and all the testator's existing intestate successors shall be named parties to the action.(c) For the purpose of this subchapter, the beneficiaries and intestate successors shall be deemed possessed of inchoate property rights.(d) Service of process shall be as in other declaratory judgment actions.Acts 1979, No. 194, §§ 2, 3; A.S.A. 1947, §§ 62-2135, 62-2136.
