Section 27-101-1007 - Submission and receipt of reports and checking applications against indexes(a) The owner of or person having a lien or encumbrance upon a motorboat that has been stolen or embezzled may notify the Office of Motor Vehicle of the theft or embezzlement, but in the event of an embezzlement, may make a report only after having procured the issuance of a warrant for the arrest of the person charged with the embezzlement.(b) Every owner or other person who has given any such notice shall notify the Office of Motor Vehicle of a recovery of the motorboat.(c) The Office of Motor Vehicle upon receiving a report of a stolen or embezzled motorboat as provided in subsection (a) of this section shall file and appropriately index the report, shall immediately suspend the certificate of number or title of the stolen or embezzled motorboat, and shall not transfer the certificate of number or certificate of title of the stolen or embezzled motorboat until such time as the Office of Motor Vehicle is notified in writing that the stolen or embezzled motorboat has been recovered.(d)(1) The Office of Motor Vehicle shall, at least one (1) time each week, compile and maintain a list of all motorboats that have been stolen, embezzled, or recovered as reported to the Office of Motor Vehicle during the preceding week.(2) The lists shall be open to inspection by any law enforcement officer or other person interested in the motorboat.(e) The Office of Motor Vehicle, upon receiving application for the certificate of number of a motorboat under § 27-101-301 et seq. or application for a certificate of title under this subchapter, shall first check the hull identification number or other identifying number shown in the application against the indexes of registered motorboats and against the index of stolen and recovered motorboats required by this section to be maintained.Added by Act 2019, No. 733,§ 16, eff. 7/24/2019.
