Section 27-51-1506 - Penalties - Public service work(a)(1) A violation of this subchapter is punishable by a fine of not less than twenty-five dollars ($25.00) nor more than two hundred fifty dollars ($250) for the first offense.(2) Each subsequent violation of this subchapter is punishable by a fine of not less than fifty dollars ($50.00) nor more than five hundred dollars ($500).(b)(1) If a person pleads guilty or nolo contendere to or the finder of fact determines that the person was involved in a collision or accident while in violation of this subchapter, a court shall in addition to any other sentence, assess an additional fine of double the amount of the standard fine imposed under subdivisions (a)(1) and (2) of this section.(2) If the collision or accident under subdivision (b)(1) of this section results in serious physical injury or death of another person, the person upon conviction is guilty of a Class A misdemeanor.(3) The law enforcement officer investigating the collision or accident shall indicate on the written accident form that the driver of the motor vehicle was using a wireless telecommunications device at the time of the collision or accident.(c) In addition to the penalties assessed under this section, the court may order the performance of public service work in the amount of one hundred (100) hours or less.Amended by Act 2023, No. 445,§ 4, eff. 8/1/2023.Amended by Act 2023, No. 445,§ 3, eff. 8/1/2023.Amended by Act 2019, No. 738,§ 6, eff. 7/24/2019.Amended by Act 2017, No. 706,§ 4, eff. 8/1/2017.Act 2023, No. 445provides this act shall be known and may be cited as "Ashton's and Abbie's Law".
