Section 20-10-113 - Fair Reimbursement and Assisted Living Cost Reporting Act of 2023(a) This section shall be known and may be cited as the "Fair Reimbursement and Assisted Living Cost Reporting Act of 2023".(b) The Department of Human Services shall annually report to:(1) The House Committee on Public Health, Welfare, and Labor;(2) The Senate Committee on Public Health, Welfare, and Labor; and(3) The Legislative Council.(c) The report described in subsection (b) of this section shall include without limitation:(1) Aggregate cost report data supplied to the department by assisted living providers;(2) The number of beds available for Medicaid beneficiaries and private pay by county;(3) Total number of beds available in the state for the most vulnerable, qualifying individuals;(4) The cost per bed to the state;(5) Rural costs compared to urban costs; and(6) Access data, including a three-year trend of access availability by county or region.(d)(1) The department shall consider the data within the report and the cost report data when making any amendment, alteration, rule change, and equitable reimbursement rate affecting the Living Choices Assisted Living Waiver.(2) The department shall report differences in the cost study and waiver reimbursement rate and potential causes of the differences.Added by Act 2023, No. 820,§ 1, eff. 8/1/2023.
