Section 16-45-102 - Officials before whom affidavits may be made(a) An affidavit may be made in this state before a judge of the court, justice of the peace, notary public, clerk of a court, or mayor of a city or incorporated town.(b) An affidavit may be made out of this state before a commissioner appointed by the Governor of this state to take depositions, or before a judge of a court, mayor of a city, notary public, or justice of the peace, whose certificate shall be proof of the time and manner of its being made.Civil Code, §§ 602, 603; Acts 1895, No. 83, § 2, p. 111; C. & M.
