Section 14-123-412 - Notice of pending suit in districts with five counties or less(a) In all suits brought by any levee district formed under the general statutes or under any special act of this state to enforce the collection of assessments, the levee district shall give notice of the pendency thereof as against all landowners, whether known or unknown, when the suits may be pending. Notice shall be given by publication weekly for four (4) weeks prior to the date of the term of court on which final judgment may be entered for the sale of land in the levee district on which the assessments are delinquent in some newspaper published in the county where the suit is pending, which public notice may be in the following form: Click here to view form.
(b) Where the owners are unknown, that fact shall be so stated in the published notice. Upon the giving of the notice of the pendency of the suit, no further notice shall be necessary to any landowner and personal summons against the landowner need not be served, and the suit shall stand for trial as now provided by law.(c) All statutory provisions contrary to the terms of this section are amended to conform hereto. However, this section shall not apply to levee districts comprising lands located in more than five (5) counties.Acts 1947, No. 141, §§ 1, 2; A.S.A. 1947, § 21-632.
