Section 14-24-101 - Issuance of warrant - Payment
(a) Whenever any allowance has been approved by any county court, in accordance with §§ 14-23-104 and 14-23-105, when requested by the person in whose favor allowance has been approved or any person authorized to receive it, the county clerk shall issue a warrant or check on the treasurer of the county for the amount of the allowance. The treasurer shall pay it out of cash available in the fund on which the warrant or check is drawn.
(b)
(1) If money is not available in the fund on which the warrant or check is drawn, the treasurer, in accordance with § 14-15-805, shall refuse payment of the warrant or check until such time as the funds are available.
(2) In counties using the "batch-redeem" warrant system, the county clerk shall ascertain from the county treasurer's records that cash is available in the fund on which the warrant or check is to be drawn before the warrant or check is issued.
