Rule 33.2 - Guidelines for Scheduling Order Limits and Summary Procedures on Appeal
(a) Scope. The following guidelines apply to assist the Court and parties appearing before it in deciding which cases merit consideration by the full Court, and which may be appropriate for:
(1) limits on briefing, oral argument, or other provisions of a scheduling order under Rule 33(b);
(2) submission to a panel of three justices under Rule 33.1;
(3) issuance of an entry order or per curiam opinion; or
(4) any combination of the above.
(b) Criteria for Full Court Disposition. A full Court opinion, issued after briefing and submission to the full Court, may be appropriate where:
(1) the Court may be establishing a new rule of law, altering or modifying an existing rule, or applying an established rule to a novel fact situation;
(2) the case involves a legal issue of substantial public interest;
(3) the Court may be criticizing existing law; or
(4) the Court may be resolving a conflict or apparent conflict between three-justice panels of the Court.
