Rule 5.3 - Cease and Desist Orders(a) The Director may issue a temporary cease and desist order if the Director determines that the action is necessary to prevent a violation of: (2) a law establishing a regulatory program administered by the Commission; or(3) a rule adopted under the Act or order issued by the Commission or the Director.(b) A cease and desist order may require a person to cease and desist from committing a violation listed under (a) or from engaging in any practice regulated by the Commission to prevent the violation.(c) A cease and desist order is effective for the duration of an investigation and any disciplinary action taken by the Commission. Within 10 days after receipt of a cease and desist order, the person to whom it was issued may file a written request for a Commission hearing on the necessity for the order, the evidence justifying the order, the duration of the order, the scope of the order, or any other matter relating to the validity of the order. The Commission must conduct the hearing within 30 days after the request.Tex. R. Judi. Cert. Commi. 5.3
