Rule 120 - Dismissals-Failure To Appeara. The Court shall mark the claim "No Service " Dismissed without Prejudice" against any defendant who is not served.b. If the claimant appears and defendant does not, and damages are proven in accordance with Rule 121, judgment by default shall be entered for claimant, provided service was made at least seven (7) days prior to trial, otherwise the claim shall be continued to a date certain.c. If the defendant appears and the plaintiff does not, judgment by default shall be entered for defendant, unless the defendant asserts a counterclaim, in which event the claim shall be continued to a date certain.d. Where none of the parties appear, the claim(s) shall be marked "Withdrawn Without Prejudice" and such claims may be reinstated upon the trial list by request of claimant.Amended July 1, 1987, effective immediately.
