Rule 2064 - COMPROMISE, SETTLEMENT, DISCONTINUANCE AND DISTRIBUTION IN ACTIONS FILED BY OR ON BEHALF OF INCAPACITATED INDIVIDUALS(a) All petitions presented for compromise, settlement, discontinuance and/or distribution in actions filed by or on behalf of incapacitated individuals shall be submitted to: (1) The assigned judge, where there is a civil action pending; or(2) A judge in the Orphans' Court Division where there is no civil action pending.(b) All approved petitions shall be filed in the Office of the Prothonotary. The guardian of the incapacitated individual shall file a certified copy of the petition and approving order in the Office of the Register of Wills under the name of the incapacitated individual. (c) In cases where no action has been filed, all petitions and orders approving compromise, settlement, discontinuance or distribution shall be filed in the Office of the Register of Wills under the name of the incapacitated individual.Amended effective 7/1/2020; amended effective 8/1/2022.
