Rule 4.016 - IN CAMERA REVIEW OF RECORDSUnless otherwise ordered by the court, a motion for the in camera review of records by the court shall be presented to the court as follows:
(1) Parties seeking an in camera review of documents in a criminal action shall file a motion supported by an affidavit or declaration which includes a description of the records to be reviewed, the information the party seeks to discover or protect contained in the records, and the legal authority for the protection or disclosure of the information contained in the records.(2) If a party is requesting the court conduct an in camera review pursuant to an application for a protective order of the material, the party must include with the motion and declaration a separate motion and proposed order to seal with a supporting declaration. The declaration in support of the motion to seal may incorporate by reference the material requested to be protected. If the court grants the protective order, the protective order, the motion and order to seal and the declaration in support may not be sealed.(3) When an in camera review involves requested disclosure of records, motions in misdemeanor cases will be calendared on the Criminal Procedure Court (CPC) docket. Motions for in camera review of records in felony cases will be calendared on the Presiding Judge's Short Matters call docket for assignment the following day. Motions on cases proceeding in the East County Courthouse will be set on a Gresham judge's calendar for hearing.(4) The records may be procured by subpoena duces tecum under ORS 136.580 before the time set for trial by directing documents to Court Records, Room 03315 of the Courthouse prior to the time of the in camera hearing. For cases that are to be heard in the East County Courthouse, documents shall be directed to 18480 SE Stark Street, Portland, OR, 97233.(5) Protective orders required to be served with a subpoena may be submitted ex parte if the form of order is stipulated by the parties.
