Rule 9.085 - PERSONAL INJURY SETTLEMENT PETITIONSA petition for approval of a settlement of a personal injury claim involving minors or incapacitated persons shall be accompanied by a declaration which sets forth the following:
(1) A description of the incident causing the injury;(2) A description of the injuries;(3) The amount of the prayer and proposed settlement, and if a structured settlement is proposed, the present value of the future payments of that settlement;(4) The amount of the attorney fees and costs;(5) The proposed distribution of the settlement proceeds; and(6) A concise statement explaining the reasons for the settlement.Amended effective 2/1/2024.
