(A) General All merit briefs shall conform to the requirements set forth in S.Ct.Prac.R. 16.01 through 16.10.
(B) Consequence of failure to file briefs (1) If the relator fails to file a merit brief within the time provided by these rules or as ordered by the Supreme Court, the original action shall be dismissed for want of prosecution.(2) Unless otherwise ordered by the Supreme Court, a dismissal under this rule operates as an adjudication on the merits. (3) If the respondent fails to file a merit brief within the time provided by this rule or as ordered by the Supreme Court, the Supreme Court may accept the relator's statement of facts and issues as correct and grant the writ if the relator's brief reasonably appears to sustain the writ.
