Section 6 - Minimum Standards for Continued Certification of Specialists(A)Fees and funding(1) The Commission shall establish and collect reasonable fees from accredited organizations.(2) The Commission shall be funded from the fees established pursuant to division (A) (1) of this section.(3) At the request of the Administrative Director of the Supreme Court, the Commission shall prepare and submit a proposed annual budget for approval by the Court.(B)Liability Accredited organizations shall hold and save the Commission and the Court, its member volunteers, officers, agents, and employees harmless from liability of any kind, including costs, expenses, and attorney fees, for any suit or damages sustained by any person or property arising out of an accredited organization's or accredited organization's application for accreditation by the Commission or arising out of any actions of the accredited organization or attorneys to whom specialization is granted or denied. (C)Public records(1) Except as provided in division (C)(2) of this section, the records of the Commission shall be available for public access pursuant to Sup. R. 44 through 47.(2) An accredited organization may request the Commission limit distribution of documents the organization has submitted to the Commission to those persons who need the information to fulfill obligations specified in these rules. In such cases, the Commission shall take reasonable steps to honor such a request, but the Commission shall not be responsible for disclosure due to circumstances beyond its immediate control. Actual or proposed written examinations submitted to the Commission shall be kept confidential.Amended February 27, 2024, effective 4/15/2024.
